1. About Lumin

Lumin is a photo storage and gallery delivery platform operated by David Casey, trading as Casey Photography, a sole trader registered in Ireland.

These Terms of Service ("Terms") govern your use of the Lumin platform, website, and services (together, the "Service"). By creating an account or using the Service, you agree to these Terms.

2. The Service

Lumin provides two types of accounts:

Lumin Pro accounts — for professional photographers to upload, organise, and deliver photo galleries to their clients.

Lumin consumer accounts — for individuals to receive, store, and manage photo galleries shared with them, including galleries from photographers and their own uploaded photos.

The Service includes features for photo storage, gallery sharing, guest uploads, photo downloads, and related activities.

3. Your Account

You must be 16 years or older to create a Lumin account. If you are between 16 and 18 you confirm that you have the permission of a parent or legal guardian to use the Service.

You are responsible for:

• Keeping your account credentials secure
• All activity that occurs under your account
• Providing accurate information when creating your account
• Notifying us immediately of any unauthorised access

You may not share your account with others or create accounts on behalf of other people without their consent.

4. Your Content

"Your Content" means any photos, videos, text, or other material you upload to the Service.

You retain all ownership of Your Content. By uploading content to Lumin you grant us a limited, worldwide licence to host, store, transmit, and display Your Content solely for the purpose of providing the Service to you. This licence ends when you delete Your Content or close your account, subject to the retention period described in Section 9.

You are responsible for Your Content. You confirm that:

• You own or have the necessary rights to upload Your Content
• Your Content does not infringe any third party rights
• Your Content does not violate any law or these Terms

5. Acceptable Use

You may not use the Service to:

• Upload illegal content, including but not limited to content depicting child sexual abuse, terrorism, or incitement to violence
• Upload content you do not have the right to share
• Infringe anyone's intellectual property rights
• Harass, abuse, or harm others
• Attempt to circumvent security measures or gain unauthorised access to the Service
• Use the Service to send spam or distribute malware
• Scrape, copy, or reverse engineer any part of the Service

We reserve the right to remove content or suspend accounts that violate these Terms.

6. Photographers and Client Galleries

When a Lumin Pro user (the "Photographer") delivers a gallery to a client (the "Client"), the Client may accept the gallery into their own Lumin account. Once accepted:

• The Client has permanent access to the gallery within their account, subject to their account status and these Terms
• The Photographer and Client each have independent relationships with Lumin regarding that gallery
• The Photographer retains the original copyright of the photographs unless separately assigned to the Client

Under data protection law the Photographer is the data controller for photographs of identifiable individuals they upload. Lumin acts as a data processor on behalf of the Photographer for such content. A Data Processing Agreement governing this relationship is available on request at support@lumin-app.com.

7. Subscriptions and Payment

Free tier and trial period

Consumer accounts can use Lumin free of charge for their first fifty photos. Once an account exceeds fifty cumulative photos across all galleries (including guest uploads), a 30-day free period begins. After 30 days, a paid subscription is required to continue uploading, downloading, or receiving new galleries. Existing photos remain visible indefinitely regardless of subscription status.

Lumin Pro accounts receive 10GB of free storage. Additional storage requires a paid subscription.

Subscriptions

Paid subscriptions are billed monthly in advance at the rates displayed on the Service at the time of subscription. Prices are in Euros and include applicable taxes where required.

Subscriptions renew automatically each month until cancelled. You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period.

Refunds

Subscription fees are non-refundable except where required by law. If you cancel mid-month, you retain access until the end of the period you have paid for.

Price changes

We may change subscription prices from time to time. We will give you at least 30 days notice before any price increase takes effect.

8. Account Termination

You may close your account at any time by contacting support@lumin-app.com.

We may suspend or terminate your account if:

• You violate these Terms
• Your account has been inactive and unpaid for more than 12 months
• We are required to do so by law

On termination:

• Your access to the Service ends
• Your content is retained for a limited period for recovery and legal purposes as described in Section 9, then permanently deleted
• Any unpaid subscription fees remain payable

9. Data Retention

When you delete a gallery, individual photos, or content within the Service, it is removed from your account immediately. Deleted content is permanently purged from our systems within 90 days. This retention period exists to protect against accidental deletion and to satisfy operational and legal requirements. It does not provide continued user access to deleted content.

When you close your account, your personal data is deleted within 30 days except where we are required to retain specific data for legal, tax, or regulatory purposes.

You may request deletion of your personal data at any time under Article 17 of the General Data Protection Regulation by emailing support@lumin-app.com. We will process valid erasure requests within 30 days, subject to any legal obligations that require retention.

10. Privacy

Our Privacy Policy explains how we collect, use, and protect your personal data. It is available at lumin-app.com/privacy and forms part of these Terms.

11. Intellectual Property

The Lumin platform, including the website, software, design, trademarks, and brand, is owned by Casey Photography. These Terms do not grant you any rights to the Lumin brand or platform beyond using the Service as intended.

"Lumin" is a business name in the process of registration with the Companies Registration Office of Ireland.

12. Service Availability

We aim to provide the Service reliably but do not guarantee uninterrupted availability. We may:

• Perform maintenance that temporarily affects availability
• Modify or discontinue features with reasonable notice
• Suspend access during incidents or security events

We will provide reasonable notice of any material changes to the Service.

13. Backups

We maintain backups of our systems for operational recovery but these are not guaranteed and are not a substitute for your own backups. We recommend you keep copies of important photos locally or with another service.

14. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

This does not affect any statutory rights you have as a consumer under Irish or EU law.

15. Limitation of Liability

To the fullest extent permitted by law, Casey Photography's total liability to you for any claim arising from your use of the Service is limited to the amount you have paid us in the 12 months preceding the claim.

We are not liable for:

• Loss of data or content
• Business interruption
• Indirect, incidental, or consequential damages

This does not limit liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be limited under applicable law.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes become effective constitutes acceptance of the updated Terms.

The "Last updated" date at the top indicates when these Terms were last revised.

17. Governing Law

These Terms are governed by the laws of Ireland. Any disputes will be resolved in the courts of Ireland. If you are a consumer in the EU, you may also bring proceedings in the courts of your country of residence.
